ACCEPTANCE OF CONTRACT TERMS: JURISDICTION

In exchange for accessing, browsing and/or using the Website, you agree to be bound by these terms and to comply with all Applicable laws and regulations, including without limitation UAE Federal Law No. 40 of 1992 concerning the Protection of the Intellectual Work and Rights of the Author and the Implementing Regulations thereof. GYC ACE is the exclusive authorized reseller for all ACE International products in the region. We do not sell ACE products through any marketplace or re-sellers. ACE products purchased from any website or seller other than GYC ACE website or store will not be covered under any ACE warranty and further will not be eligible for refunds, returns, exchange or any other claims whatsoever.

GYC ACE warranty does not extend to:

• Damage, defects and/or faults caused by negligence, misuse, accidents, weather and other natural disasters or fault owing to deviation from recommended use of the products and/or poor installation of the product, unless such installation was done by the ACE team.
• Damage, defects and/or faults caused by liquid damages/defects
• Screen & display damages
• Damage, defects and/or faults caused by abnormal voltage or incoming power supply from a generator or fluctuations
• Damage, defects and/or faults caused by chemical reactions, excessive heat, excessive dust, excessive rains, corrosive surrounding or any natural factors beyond the control of ACE.
• Normal wear & tear.
• Products which has been opened up, repaired or tampered with by unauthorized third party agents or other service centers
• Accessories, batteries and consumables (including but not limited to bulbs, lamps, cartridges, toners, drums, print heads etc.)
• Items without sales invoice and/or valid manufacturer warranty
• Software issues or data back-up issues
• Image retention on TVs and similar electronics
• Accessories such as but not limited to discs, control pads, adapters, chargers, power bands, headsets etc.
• GYC ACE acting reasonably, reserves the right to reject any GYC ACE warranty claim at its discretion.

DISCLAIMER OF LIABILITY

Effective 1 Jan, 2018, the UAE Government has introduced Value Added Tax (VAT) at a standard rate of 5%. EXCHANGE GUARANTEE ON SMALL APPLIANCES

• • • ACE Exchange Guarantee (Guarantee) is a replacement guarantee program available to customers who have purchased Small Domestic Appliances/SDA (excluding microwave ovens) from ACE whether online or in-store.
    • The program gives the benefit to the customers to get their faulty small domestic appliances exchanged in case of mechanical or electrical breakdowns for a nominal fee.
    • The applicable guarantee fee needs to be paid to be enrolled for the Exchange Guarantee program.
    • The fee for the ACE Exchange Guarantee program is as below:

• • • It covers small domestic appliances (except microwave ovens) proven as defective due to mechanical or electrical breakdown only, which means that the item suffers from a failure of a component which is required for its functionality or safe usage.
    • This Guarantee is only applicable for the period of 1 year from the date of purchase of the item by the customer
    • To avail Exchange Guarantee, please bring the faulty item to any ACE UAE store for inspection along with the original proof of purchase.
    • The item must be in original packaging and must include all accessories that originally came with the item.
    • In case item is bought under Buy 1 Get 1 promotion, only the main item is covered under Exchange Guarantee
    • If the purchase price of the guaranteed item cannot be determined because it was bought in combination with other products or services, ACE reserves the right to confirm the price of such item(s).
    • The Guarantee applies only to small domestic appliances purchased by the customer for domestic use. Any items purchased for commercial or for hire/leasing purposes will not be covered under the program.
    • Original proof of purchase is a must to avail the Exchange Guarantee
    • Consumable components such as filters, pads, chemicals, which must be replaced or serviced from time to time are not covered by this Guarantee.
    • ACE’s limit of liability shall not exceed the Original Purchase Price of the item (including VAT) as stated on the Proof of Purchase.
    • The replacement item will either be the same item or a similar product with the same Original Purchase Price (including VAT)
    • The Exchange Guarantee is not applicable in the following cases:
      • The original proof of purchase is not presented
      • The original proof of purchase has been altered or is illegible
      • The item purchased is used for commercial or for hire/leasing purposes
      • Any repair (or attempted repair) of the item will void this Guarantee, whether or not the damage has been caused by that repair/attempt.
      • Removing or tampering the product rating label or seal will void this Guarantee
      • Incorrect storage, use or operation of item contrary to safety standards, physical or program damage due to misuse is not covered by this Guarantee.
    • The decision of the ACE technician or manufacturer’s authorized service technician, as applicable, shall be final
    • ACE reserves the right to vary, modify or change this Guarantee herein due to change(s) in availability of services, products and/or spare parts or for the purposes of complying with applicable policies, rules, regulations and law, with or without notice.
    • This Guarantee and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation, shall be governed by and construed in accordance with the law of UAE

5 YEAR WARRANTY ON PREVIOUSLY PURCHASED PRODUCTS

ACE no longer offers free 5-year warranty on purchase of large appliances. However, for our customers who had purchased large appliances prior to the discontinuation of free warranty, the below terms & conditions apply.

In its 1st year, your Manufacturer's warranty is applicable subject to the below terms & conditions:

• • • Manufacturer's warranty (M Warranty*) is applicable as per terms and conditions provided by the manufacturer inside the packaging of the product and will commence from the date of purchase mentioned on the invoice.
    • M Warranty terms will be as provided by the manufacture/principal supplier of the product purchased and GYC ACE is a facilitator only.
    • M Warranty becomes invalid if the product has been opened or tampered with by an unauthorized person or unauthorized service center.
    • Invoice and warranty card must be retained in order to claim the M Warranty.
    • M Warranty is applicable within limits of UAE only, unless specified by the manufacturer.
    • If the M Warranty offered is for more than 1 year, then GYC ACE warranty will continue after the M Warranty period is over for a total period of not more than 5 years including the M Warranty period.

In its 1st year, your Manufacturer's warranty is applicable subject to the below terms & conditions:

• • • GYC ACE Warranty will commence from the end date of the M Warranty until 5 years from the invoice date.
    • GYC ACE lability under the GYC ACE Warranty is limited to repairing/replacing of defective products only. The GYC ACE Warranty does not cover any losses and damages caused directly or indirectly by the products.
    • GYC ACE Warranty covers items used for domestic/household use only, within applicable limits in UAE.
    • GYC ACE Warranty is valid only on TVs, refrigerators, washing machines, tumble dryers, cooking range, & dishwashers worth AED 500 & more.
    • Collection & delivery of faulty products will incur a charge of AED 100 and is only available within Abu Dhabi, Dubai and Sharjah - for items below AED 5,000.
    • If the product is not repairable, GYC ACE will either refund or replace the faulty Product as it may deem fit at its sole discretion
    • Refunds will be in the form of Gift voucher to be redeemed at GYC ACE and the value of such gift voucher will be calculated at 75% of invoice value for the 2nd & 3rd year & 50% of the invoice value for the 4th & 5th year.
    • A replacement product will only be provided once the cause of damage has been determined and can be concluded as owing to mechanical failure and not having been caused by negligent use by the purchaser and/or any third party, nor has been damaged on purpose. The replacement product will be a refurbished product of same or similar specification and value.

GYC ACE warranty does not extend to:

• Damage, defects and/or faults caused by negligence, misuse, accidents, weather and other natural disasters or fault owing to deviation from recommended use of the products and/or poor installation of the product, unless such installation was done by the ACE team.
• Damage, defects and/or faults caused by liquid damages/defects
• Screen & display damages
• Damage, defects and/or faults caused by abnormal voltage or incoming power supply from a generator or fluctuations
• Damage, defects and/or faults caused by chemical reactions, excessive heat, excessive dust, excessive rains, corrosive surrounding or any natural factors beyond the control of ACE.
• Normal wear & tear.
• Products which has been opened up, repaired or tampered with by unauthorized third party agents or other service centers
• Accessories, batteries and consumables (including but not limited to bulbs, lamps, cartridges, toners, drums, print heads etc.)
• Items without sales invoice and/or valid manufacturer warranty
• Software issues or data back-up issues
• Image retention on TVs and similar electronics
• Accessories such as but not limited to discs, control pads, adapters, chargers, power bands, headsets etc.
• GYC ACE acting reasonably, reserves the right to reject any GYC ACE warranty claim at its discretion.

ACE EXTENDED WARRANTY

• • • The Extended Warranty lets you extend the warranty period of your large appliance purchased from ACE beyond what is offered by the manufacturer. It covers the cost of replacement or repair of the product, if it is caused due to a manufacturing defect or poor workmanship.
    • The ACE Extended Warranty is provided in partnership with Orient Insurance, GYC, United Arab Emirates.
    • The Terms & Conditions together with Your Certificate of Insurance form the insurance contract between You and Us, which will be referred to as the Insurance Policy. In case of conflicts, the provisions on the Certificate of Insurance apply first, and then the Terms & Conditions, in that order.
    • This Extended Warranty is only valid if You are:
    • Aged 18 years or over, and
    • Your Country of Residence is the United Arab Emirates. Please note that this must remain as Your Country of Residence throughout the Period of Insurance in order for Your Insurance Policy to be valid.
    • This Extended Warranty is only valid for the Insured Object, i.e. Large Appliances:
    • Purchased by You from ACE, and
    • Used in accordance with the manufacturer’s guidelines, and
    • Used to domestic and personal use.
    • This Extended Warranty is only valid if purchased:
    • Together with the Insured Object, or
    • Up to 15 days after the insured Object Purchase Date.
    • The start date of the Extended Warranty Insurance Policy is stated in the Certificate of Insurance that forms part of Your Extended Warranty Insurance Policy.
    • The Extended Warranty Insurance Policy will expire as per the expiry date shown on Your Certificate of Insurance if neither You or We have cancelled the it.
    • The Insurance Cover will only start once You have paid the Premium, subject to any applicable Waiting Time and in any case, not before the expiry of the manufacturer’s warranty.
    • Cancelling Extended Warranty During Cool Off Period:
    • You are entitled – within 15 and with no obligation to state Your reasons – to cancel the Insurance Policy in writing sent to the contact details as below:

    • By calling: 800 275 223
    • The 15 period commences once You have received Your Certificate of Insurance.
    • If You have not made or will not make any valid claims during the Cooling-off Period, You will receive a full refund of Your Premium.
    • If You make a valid claim during the Cooling-off Period You are still entitled to cancel Your Insurance Policy however We will ask You to pay back the benefit received.
    • Cancelling Extended Warranty After Cool Off Period:
    • If You pay Your insurance Premium:
    • o Annually: You will receive a proportionate refund of Premium based on the unused period of cover under the Insurance Policy. Insurance Policy cover will cease from the date We receive Your cancellation instructions or from a later date at Your request.
    • o On a monthly basis: Your Insurance Policy will be cancelled at the next monthly anniversary of the date Your Insurance Policy commenced. There will be no refund of Premium paid as the Premium paid will have only been in respect of the Insurance Cover already received.
    • There will be no partial refunds in case of an Extended warranty sale
    • In case the customer want to cancel the extended warranty, the article purchased along with the Extended Warranty should be the part of return/refund
    • Termination by Insurer: We may be entitled to terminate Your Insurance Policy or to change the terms of Your Insurance Policy with immediate effect if You:
    • Have acted dishonestly or provided incomplete information when taking out the Insurance Policy;
    • Have purposely misrepresented or failed to disclose the facts when submitting a claim;
    • Have committed or attempted to commit fraud.
    • In such circumstances, We will not return any of the Premium to ny amendments to the Insurance Policy or to the Certificate of Insurance shall require written confirmation by Us.
    • In the event of a grossly negligent breach of the following obligations, We shall be entitled to invalidate Your Insurance Policy and have no liability for associated claims or to reduce the benefits payable commensurate with the severity of Your fault.
    • You have to observe the following legal obligations to keep Insurance Cover:
    • To comply with all the Terms & Conditions.
    • To not purchase the Insurance Policy if We have previously informed You that We do not want to insure You. In this case We will refund any Premium paid by You.
    • To inform Us as soon as possible/ within 30 days of any changes that arise and that may affect the Insurance Cover.
    • To provide Us with complete and accurate information when purchasing the Insurance Policy and making a claim.
    • If costs are incurred due to false or untruthful information, which would otherwise not have arisen had the information provided been accurate, We reserve the right to demand payment of these costs.
    • To take Reasonable Precautions, to the best of Your ability, to keep the Insured Object in good working order, and take reasonable care to prevent or, at least, minimize the risk of damage or loss.
    • If the Insured Object becomes damaged or destroyed during the term of the Insurance Policy, You must, as soon as reasonably practical, notify Us and, where necessary, provide Us with the Insured Object (including any In Box Accessories) so that We may examine it.The governing law is the law of United Arab Emirates and all communications and documentation in relation to this Insurance Policy will be in Arabic. Any disputes arising out or in connection with the Insurance Policy shall be brought before the competent courts of United Arab Emirates.
    • The following is excluded from the Insurance Cover:
    • Objects other than specific / unique Insured Object for which the insurance was purchased.
    • Consumable Parts: Parts of the Insured Object that can be replaced by You, as detailed in the manufacturer’s operating guidelines, the replacement of which might be required to restore the functionality of the Insured Object.
    • Loaned objects: When the Insured Object is lent out by You or when the Insured Object is borrowed from someone else by You
    • Objects/parts purchased by You from Grey Market.
    • Counterfeit objects or objects without CE marking or a comparable certification mark (This marking signifies that objects sold in the EEA have been assessed to meet high safety, health, and environmental protection requirements).
    • In Box Accessories
    • Objects with serial number or IMEI number removed, defaced or altered.
    • The following events are excluded from the Insurance Cover:
    • Outside of Period of Insurance: Any incident that occurred before the start date or after the end date of Your Insurance Cover as shown on Your Certificate of Insurance Policy.
    • Accidental Damage: Damage caused by an unexpected and non-deliberate event occurring at a definable time and place and impairing the functionality or safe use of the Insured good.
    • Pre-existing damage or fault with Your Insured Object.
    • Faults or failures covered by the manufacturer’s Warranty.
    • Any breakdown of the device if the type of fault would not have been covered under the manufactures warranty.
    • Any incomplete in-warranty repair.
    • Damage caused by use not in accordance with the manufacturer‘s instructions, (e.g. wronssembly).Damage caused by serial production faults as well as damages related to recall campaigns conducted by the manufacturer;
    • Use of the Insured Object for commercial or other non-personal use.
    • You acting illegally or breaking any government prohibition or regulation or illegal use of the Insured Object.
    • Negligent or improper use of Your Insured Object
    • Intentionally caused damage: Damage created by deliberate acts or omissions on the part of the Insured Person or damage caused to Your Insured Object by an authorized user.

Standard Warranty & Parts Warranty:

The below warranty terms & conditions are only applicable for Siemens Built-In appliances covered by its 3-year warrant promotions.

1. Standard Warranty:

• This warranty covers both Parts & Labor with unlimited service interventions. Product replacement is applicable only in case of Product Quality or Repeat failures.

• This warranty covers the supply of the part only. The cost involved during any part replacement, labor, and other consumables like gas etc. must be borne by the customer. Product replacement is not applicable during the part warranty period.

• Warranty Coverage: The warranty covers any defects in materials or workmanship under normal usage.

• Exclusions: Damage or defects related to plastic, glass doors, burners, rubber parts, and non-operational parts determined by the company as subjected to normal wear and tear are not covered.
